Abstract

Abstract: Playwrights spoke rarely of the censorship, this surveillance which weighed for so long on theatrical creation and the writing of the plays. Was this silence the result of a tacit agreement, of resignation, or of indifference and absence of reflection? There were some prefaces and manifestos of protest, a few lawsuits brought, but few testimonies of the authors until 1849. A year and a half after the suppression of censorship by the decree of 6 March 1848, the government of the Second Republic, anxious to regain a certain power over the theatres, asked the Council of State to conduct a great inquiry into the two obstacles to the freedom of theatrical creation: the privileges granted to theatres on the one hand, and censorship on the other. They interviewed ten playwrights, but also directors of theatres, critics, actors and censors, a total of thirty-two personalities. We study here the responses and proposals for the reform of the ten dramatists, all but one of whom, Scribe, agreed on the definitive suppression of preventive censorship of texts. All agreed, and this time unanimously, for this censorship to be replaced by a reinforced repression of representations. Total freedom was not conceivable. When it was necessary to think of the organization and means of this repression, the same idea, for the ten playwrights, took shape: that of a jury. As for the formation and powers of this jury, the vagueness and lack of precision were proof of the lack of reflection, both in the Society of Authors (sacd), and in personalities like Dumas or Hugo. Some authors were for the better reproduction of the commission which formerly grouped the censors and inspectors, within the Ministry of the Interior. Others were for a tribunal of appeal, composed of personalities and only regulating conflicts resulting from the repression. Others, including Victor Hugo and Souvestre, were for a tribunal composed exclusively of authors, a kind of emanation of the Society of Authors (sacd). This jury never saw the light of day: the authoritarian government, with the future emperor for president, voted the law of July 1850 restoring the censure, without taking into account the work of the Council of State. This inquiry, however, served, later, as a basis for reflection, when the government of the Third Republic commissioned the Chamber of Deputies to carry out a similar inquiry into the censure which continued to prevail and which disappeared, without law, only in 1906.

Résumé : Les dramaturges se sont peu exprimés sur la censure, cette surveillance qui pesa si longtemps sur la création théâtrale et l’écriture des pièces. Ce silence venait-il d’un accord tacite, ou d’une résignation, ou encore d’indifférence et absence de réflexion ? Il y eut bien quelques préfaces et manifestes de protestation, quelques procès intentés, mais peu de témoignages des auteurs jusqu’en 1849. Un an et demi après la suppression de la censure par le décret du 6 mars 1848, le gouvernement de la Seconde République, soucieux de retrouver un certain pouvoir sur les théâtres, demanda au Conseil d’État de mener une grande enquête sur les deux entraves à la liberté de création théâtrale : les privilèges accordés aux établissements d’une part, la censure d’autre part. Furent interrogés dix dramaturges, mais aussi des directeurs de théâtres, critiques, acteurs et censeurs, au total trente-deux personnalités. Seules sont étudiées ici les réponses et les propositions de réforme des dix dramaturges qui, tous sauf un, Scribe, furent d’accord pour la suppression définitive de la censure préventive, celle portant sur les textes, et qui, tous, furent d’accord également, et cette fois-ci de façon unanime, pour que cette censure soit remplacée par une répression renforcée des représentations. La liberté totale n’était pas envisageable. Quand il fallut penser à l’organisation et aux moyens de cette répression, une même idée, chez tous encore, prit forme : celle d’un jury. Quant à la formation et aux pouvoirs de ce jury, l’imprécision, le flou furent la preuve du manque de réflexion, aussi bien chez la Société des Auteurs (sacd), que chez les personnalités comme Victor Hugo. Certains auteurs étaient pour la reproduction améliorée de la commission qui groupait auparavant les censeurs et inspecteurs, au sein du ministère de l’Intérieur. D’autres étaient pour un tribunal d’appel, formé de personnalités et réglant les seuls conflits issus de la répression. D’autres enfin, dont Victor Hugo et Souvestre, étaient pour un tribunal formé d’auteurs exclusivement, sorte d’émanation de la Société des Auteurs (sacd). Ce jury ne vit jamais le jour : le gouvernement autoritaire du futur empereur vota la loi de juillet 1850 rétablissant la censure, sans tenir aucun compte du travail du Conseil d’État. Cette enquête servit cependant de base de réflexion, lorsque le gouvernement de la Troisième République chargea la Chambre des députés de mener une semblable enquête sur la censure qui sévissait toujours et qui ne disparaîtra, sans loi, qu’en 1906.
